If your business has a temporary or fixed term position vacant you may be able to engage an international employee via the 457 Temporary Skilled worker visa stream.

To do this, your business needs to sponsor a candidate. To be able to sponsor a candidate, your business needs to be an accredited business sponsor.

The main components to becoming an accredited business sponsor include:

  1. being a registered business with an ABN,
  2. demonstrating your business has a training program in place.

Once your business is an accredited business sponsor, you can start the process of sponsoring a 457 skilled worker.

If you have a requirement for a skill that isn’t available locally, you can then nominate a position.

The position needs to be listed on the Consolidated Skills Occupation List (CSOL).

Nominating a position includes:

  1. showing the occupation is relevant to the position to be filled,
  2. outlining the skills and experience required for the position,
  3. stating the market salary rate for the position and the salary rate to be paid to the candidate.

Subclass 457 visas are valid for up to 4 years. Australian employers can sponsor 457 employees onto permanent residency in 2 ways, via the:

  • Employer Nomination Scheme (ENS)
  • Regional Sponsored Migration Scheme (RSMS)

Sponsoring permanent positions

The Permanent Employer Sponsored Programme consists of 2 migration pathways:

Employer Nomination Scheme (ENS)

This visa entitles your sponsored employee to permanent residency in Australia.

For a candidate to qualify for this visa, they must:

  • be sponsored by an Australian employer
  • have an occupation that is included on the Consolidated Sponsored Occupation List.
  • show that they are qualified in the nominated occupation by presenting recognized qualifications and experience and/or having their trade skills assessed by the relevant assessment authority.
  • pass character, health, language and age checks.

Regional Sponsored Migration Scheme (RSMS)

This visa entitles your sponsored employee to permanent residency in Australia.

For a candidate to qualify for this visa, they must:

  • be sponsored by an employer based in regional Australia.
  • have an occupation that is included on the Consolidated Sponsored Occupation List.
  • show that they are qualified in the nominated occupation by presenting recognized qualifications and experience and/or having their trade skills assessed by the relevant assessment authority.
  • pass character, health, language and age checks.
